Hate Speech and "Dog-Whistles:" Global Perspectives and the First Amendment


Professor Michael M. Epstein


Professor Michael Epstein will be speaking about hate speech under national law and treaty. The talk will look comparatively at hate speech as a bellwether of individual repression and group libel laws as state-sanctioned speech orthodoxy. Topics will include the history of hate speech laws as they originated in Europe, with special focus on Holocaust denial, and attempts to curtail hate speech under the First Amendment in the United States.  We will also explore current speech codes and group libel cases in various countries that are representative of different cultural speech norms.


Michael EpsteinProfessor Michael M. Epstein is a Professor of Law at Southwestern Law School in Los Angeles. A founding faculty member of the Donald E. Biederman Entertainment and Media Law Institute at Southwestern, Professor Epstein is an interdisciplinary scholar specializing in media, telecommunications, international law, and popular culture. Since 2009, Professor Epstein has been the principal editor of the Journal of International Media and Entertainment Law, a faculty-edited law review published by the Biederman Institute in cooperation with the American Bar Association. He also directs the Amicus Project at Southwestern, a pro bono outreach program which invites law students to prepare "friend of the court" briefs before the U.S. Supreme Court and in other jurisdictions.
